ATO

To apply to the ATO, you must include relevant itemised quotes or invoices that:

  • are dated and provided on the medical practitioner’s letterhead.
  • are no more than six months old (for quotes).
  • are no more than 30 days old (for unpaid invoices).

You may also apply for certain paid expenses where money has been borrowed to cover the cost, and the borrowed amount remains outstanding.

The reports supporting your application must be:

  • 2 completed compassionate release of super request reports for the ATO signed and dated submitted with your application.
  • 1 from a registered medical specialist (Our team of Psychiatrists at FertilityPsych)
  • 1 from either a registered medical practitioner or another registered medical specialist (either your GP or FertilityPsych).

These reports are valid for 6 months less 1 day of your appointment with each doctor to receive these reports. You can use them multiple times for applications during this period. Once the 6 months has passed, you will require a new appointment to receive a new report to be deemed valid by the ATO.

The ATO can only approve your application if you:

  • meet the eligibility requirements for the compassionate ground you’re applying under.
  • are unable to meet the expense without accessing your super (for example, through savings or a loan).
  • are, or have been, a citizen or permanent resident of Australia or New Zealand.
  • provide all required supporting evidence, including relevant invoices/quotes.

The ATO can only approve the application if you:

  • meet the eligibility requirements of the compassionate ground you’re applying for
  • can’t afford to pay the expenses without accessing your super e.g. by obtaining a loan or using your savings
  • are or have been a citizen or permanent resident of Australia or New Zealand
  • provide all required supporting evidence and invoices/quotes

The amount of superannuation you can withdraw is limited to what you reasonably need. It is paid and taxed as a normal lump sum, this is generally at a rate up to 32% but can differ depending on your circumstances. Your super fund will automatically deduct the tax from your super account, in addition to the approved release amount – the amount you receive from the release will not be affected.

Please note, we are not financial advisors or registered tax agents. We strongly recommend seeking independent legal, financial, or taxation advice to understand how early Super access may impact your situation.

The ATO medical report form is a standard ATO document and can be downloaded here. We already have this form on our system, therefore, you do not need to send us a blank copy.

The ATO may decline an application for several reasons. In many cases, this is due to a minor or administrative issue (such as missing dates or wording that needs clarification).

  • The ATO will send you a letter advising why your application was declined.
  • If you don’t understand the decision, you can contact the ATO for further explanation.

If adjustments are needed to documentation we’ve provided, please contact us and we’ll be happy to assist where possible.

The ATO can review their decision if disputed within 14 days.

Other

Once both CRS reports are completed, the processing time of the application, once submitted can take up to 2 weeks. When you receive your approval letter, you’ll then forward it to your superannuation fund. We recommend checking directly with your fund to confirm how long they may take to release the funds.

Important: During tax return season, the processing time of the application can increase beyond 2 weeks.

Our appointments are conducted by psychiatrists, who are registered medical specialists when Psychologists are not. The ATO requires CRS forms to be completed by a registered medical specialist, which is why this step is necessary.

Reach out to us! CRS reports are only valid with the ATO for a limited time, and we’re happy to support you with a follow-up appointment to provide an updated report for the ATO to deem acceptable

The ATO only allows early access to superannuation for unpaid medical invoices.

Two CRS reports are needed: one from us and one from either your GP or Fertility Specialist. It’s helpful to know who will be completing your second form prior to our appointment so we can ensure they receive our report directly and instructions to assist them to complete their report.
